This Privacy Policy explains how Belmont Neuro Physio collects and stores information about you either from the website, or the clinical records that are created as part of the physiotherapy assessment and treatment process. This is in accordance with the Data Protection Act 1998 and UK General Data Protection Regulation (UK GDPR). Both set out how personal data can be used, processed and protected. Belmont Neuro Physio has a legal obligation to keep information about you confidential and this responsibility is taken very seriously. Belmont Neuro Physio (Clare Belmont) is registered with the Information Commissioners Office (ICO) to hold data that is relevant to providing you with the appropriate assessment and treatment.

What Information is Collected?

From the Website

Belmont Neuro Physio collects and processes the following information from the website www.belmontneurophysio.co.uk:

  • Name (required), email address (required) and phone number (optional).

  • The information that you provide through the message box of the website contact form or directly via email through the clare@belmontneurophysio.co.uk link on the website contact form. By providing information through the website or by email you are consenting to the collection and processing of this information. Belmont Neuro Physio recommends limiting personal information entered for an initial enquiry as this is not a secure mode of communication. More detailed personal information is better left for a telephone call or an initial face-to-face assessment.

  • The website collects Cookies. On visiting www.belmontneurophysio.co.uk you are given the option to opt in or opt out of Cookies. Cookies are small pieces of data that websites store on your computer/electronic device that you are using, to help the website run effectively and provide the best experience for visitors. They also provide Belmont Neuro Physio with analytics such as how visitors are using the website. This information is only used for statistical purposes.

From Clinical Assessment and Treatment Records

The following information may be collected and processed if you choose to proceed with an assessment and/or treatment with Belmont Neuro Physio:

  • Details about you and your support network such as date of birth, address, telephone number, email, next of kin details.

  • Contact details of health and community services involved in your care such as GP surgery, specialist services, medical providers, care providers.

  • Health information that is relevant to my assessment and treatment such as your past medical history and the history of your present condition.

  • Health, care and rehabilitation Information from other healthcare professionals that have been involved in your treatment.

  • Information from legal representatives and case managers.

  • Information provided by your next of kin, relatives or those that care for you.

Who Your Personal Information May be Shared With

Belmont Neuro Physio will only pass information about you and your care onto others if you have given your explicit consent to do so. For example, Belmont Neuro Physio will request your consent to share any written reports or clinical notes about your assessment or treatment with other health professionals, solicitors, or case managers, where these parties have a genuine need for this information.

Any personal information about you that is sent via email to other parties will be encrypted and/or password protected.

How Your Personal Information is Stored

Your records held by Belmont Neuro Physio may be on paper, electronic or a combination of both. Handwritten paper records may be taken during an assessment or treatment and later copied into an electronic format. Paper notes will be stored at Belmont Neuro Physio in a locked filing cabinet. If records are copied into an electronic format, the original paper notes will be destroyed (shredded). All electronic notes are stored on a laptop that is password protected and is solely used by Clare Belmont of Belmont Neuro Physio. The password is known only by Clare Belmont and is regularly changed based on password protection recommendations from the Information Commission Office’s.

NHS England’s Records Management Code of Practice states clinical records should be kept for eight years (adults). After 8 years Belmont Neuro Physio will destroy all paper (shredding) and electronic records (secure deletion).

Data Protection Regulations

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases Belmont Neuro Physio relies on for processing the information described above are:

(a) Your consent.

You are able to remove your consent for Belmont Neuro Physio to process your personal data at any time. You can do this by contacting me directly at clare@belmontneurophysio.co.uk. All processing of your personal data will cease from this point, but this will not affect any personal data that has already been processed prior to this point.

(b) Lawful basis

Health professionals have a legal obligation to keep records of all assessments, treatments, and contacts they have with other health professionals or services relevant to your assessment and the delivery of your treatment. Legislation also requires information to be held as proof of an activity against the eventuality of a claim. Records management guidance from NHS England states that records related to your health and care must be held for eight years (adults).

(c) Contractual obligation.

If you enter into a contractual agreement for Belmont Neuro Physio to be employed to provide physiotherapy assessment and treatment, personal information is required to send, receive and process invoices for services that you have received.

Your Data Protection Rights

Under data protection law, you have rights including:

  • Your right of access - You have the right to ask me for copies of your personal information.

  • Your right to rectification - You have the right to ask me to rectify personal information you think is inaccurate. You also have the right to ask me to complete information you think is incomplete.

  • Your right to erasure - You have the right to ask me to erase your personal information in certain circumstances. This request can be denied if the data relates to your health and care as I am legally obliged to keep health and care records for eight years (adults). Requests will be managed on a case-by-case basis.

  • Your right to restriction of processing - You have the right to ask me to restrict the processing of your personal information in certain circumstances. This may relate to whom you consent to your information being shared with (ie other healthcare professionals, relatives).

You are not required to pay any charge for exercising your rights. If you make a request, Belmont Neuro Physio has one month to respond to you.

If any of your personal details change, you have a responsibility to inform Belmont Neuro Physio of these changes so that we can keep your records up-to-date.
